Naftogaz has secured a final victory against Gazprom in the Federal Supreme Court of Switzerland over a claim exceeding $1.4 billion. The court fully rejected Gazprom’s attempt to overturn the arbitration ruling issued on June 16, 2025. The decision obliges the Russian company to pay its debt for natural gas transit organization services with interest.

In the summer of 2025, Gazprom launched proceedings to cancel the arbitration ruling and simultaneously asked the court to suspend its enforcement until the review ended.
In November 2025, the Federal Supreme Court of Switzerland rejected Gazprom’s request to suspend enforcement. The court also dismissed the company’s appeal on the merits.
The court also ordered Gazprom to pay legal costs of 200,000 Swiss francs. It must also compensate Naftogaz with 250,000 francs for expenses incurred during the proceedings before the court.
Naftogaz CEO Serhii Koretskyi said the company will continue efforts to enforce the ruling and pursue other legal actions against Russia.
Context
Under the 2019 agreement, Naftogaz organized gas transit through Ukraine for Gazprom until January 1, 2025.
In May 2022, Russian military actions made transit through the Sokhranivka entry point impossible. However, Naftogaz continued to provide transit services through the Sudzha entry point.
Gazprom refused to pay the full amount, violating its contractual obligations and triggering arbitration proceedings in Switzerland. In June 2025, the arbitration tribunal found Gazprom responsible for failing to meet its payment obligations and ordered the company to pay the debt, interest, and arbitration costs.
